In the good ole days – say, the turn of the last century – a farmer sued a tractor’s vendor for false advertising.  Since he could do more work with 8 horses than with his 16-horsepower tractor, clearly it was false advertising to say that the tractor’s engine generated 16 horse-power.

There you have it.
